The Case
Neligan LLP represented a tort claimants’ committee, composed of plaintiffs’ lawyers, in the Chapter 11 case of U.S. Brass, a plumbing manufacturer. The tort claims exceeded one billion dollars, and the firm worked to ensure that the debtor provided these tort claimants with a fair distribution to compensate both known and unknown victims. On behalf of the tort victims, Neligan LLP succeeded in terminating exclusivity and filed its own competing plan of reorganization on behalf of all creditors. Ultimately, the court confirmed a joint plan, supported by the tort claimants’ committee and other parties, which provided up to one billion dollars of compensation for tort victims.
